Pond Lehocky Settles $3 Million Workers’ Compensation Case

Sam Pond, Managing Partner of Pond Lehocky Stern Giordano secures a $3,000,000.00 Workers’ Compensation settlement. It appears to be the highest, or one of the highest Workers’ Compensation Settlements in the country.

A $3,000,000.00 settlement was obtained for a union construction worker, who was catastrophically injured at the young age of 31 while he was working as a construction flag man for Liberty Construction directing traffic on the highway. The work injury caused him to be a C4 quadriplegic.  The Claimant was married with a 6 month old child at the time of his injury.

The Claimant  had stopped several cars the day he was injured. The driver of the last car in line ignored the order to stop. He sped around a line of vehicles striking our client, who witnesses say was thrown 15 feet into the air and about 60 feet from the point of impact.

The settlement occurred after years of negotiations, with the insurance company initially offering below one million dollars.  Pond says, “The complexities of the case, including the funding of a Medicare fund, the Social Security Offset, the reduced benefits as a result of the Third Party lien, the client’s future lifetime medical needs, and the possibility of an attack by the insurance company on the claimant’s medical treatment, all had to be weighed and factored into getting the best possible result for our client.”
